Divorce is a relatively simple process which you can complete yourself. There is no requirement that one party be at fault. For the Court to grant a divorce, all that is required is:
- that the parties had been validly married,
- the parties have been separated for at least 12 months, and
- appropriate arrangements have been made for the care of the children of the relationship (if any).
Should you have children from the relationship, you are required to have reached an appropriate agreement about their care before the Court will grant your Divorce.
If you need to divide any assets in your separation (such as a house, business, car, furniture, savings, superannuation etc.) you are not required to have a reached an agreement as to how these items will be divided, before obtaining a Divorce. However, you do have a set period after being granted a Divorce to make the appropriate application for the allocation of these items. You will need to consult a Solicitor before these time limits expire.
