If parties go to court, or are contemplating a property settlement or similar, then the court requires them to let each other know about all documents which are in the possession of the party or under the control of the party.
Discovery can be made by a list of documents which sets out all of the documents which are relevant to the court proceedings and are in the possession, power or control of a party. After the lists of documents have been exchanged, a process of inspection where the solicitors for the parties (and perhaps the parties themselves) go to the office of the other solicitor and sit down to inspect all of the documents which are set out in the list of the other party. At that inspection or afterwards, we can request copies of any document. After discovery and inspection, the parties should have a full understanding of the financial position of each party and they can negotiate with certainty. |
